High court calls for review Stella Nyanzi case

Stella Nyanzi asked the High court to review the ruling of magistrate Gladys Kamasanyu

Stella Nyanzi asked the High court to review the ruling of magistrate Gladys Kamasanyu

Dr Stella Nyanzi's trial at Buganda Road Chief Magistrate's court maybe halted for some time after the High court in Kampala called for her file.

According to the July 18 letter from the registrar of criminal division, High court, Mary Ikit, Nyanzi applied for the revision of the ongoing criminal proceedings in the case before Grade One magistrate Gladys Kamasanyu.

The letter addressed to the Buganda Road chief magistrate states "you are directed to forward the original file with certified copies of proceedings and exhibits if any, as soon as possible."

The latest development comes a day after Buganda Road court magistrate closed the case pending judgment. Kamasanyu had set August 1 as date to deliver her judgment in the case in which Nyanzi is charged with offensive communication and cyber harassment. Nyanzi’s lawyer Isaac Semakadde couldn’t confirm or deny that they had applied for judicial review of the proceedings.

“We have no comment at this stage," Semakadde said on phone.

However Judiciary spokesperson Solomon Muyita confirmed the development saying that the letter from High court is authentic.

"The letter is authentic. Nyanzi’s lawyers filed an application seeking a review for the ruling delivered recently by Kamasanyu," said Muyita.

In the ruling, Kamasanyu had declined to grant an order to have Nyanzi issue an advert in the media soliciting for willing witnesses to come and defend her after the ones she'd listed failed to appear in court. Kamasanyu argued that the request was not only alien and queer in the legal practice, but also misdirecting the court and perhaps to make people lose confidence in the judicial system.

Kamasanyu thus closed the trial before the defense lawyers could submit witnesses in Nyanzi's defense. She said Nyanzi had not only chosen to sit on her own right to defend herself but also use it as a weapon to frustrate further proceedings in her own case.

Nyanzi is in court on allegations that she posted a loutish birthday poem on her Facebook page on September 16, 2018 attacking the late mother of President Yoweri Museveni, Esteri Kokundeka.
She was arrested on November 2, 2018 and has since been in Luzira prison following her refusal to apply for bail. Prosecution laid evidence from three witnesses including detective assistant superintendents of police Bill Ndyamuhaki, Harriet Kenyana and lawyer Charles Dalton Opwonya who pinned her of the offences in question.

I think Court should re-visit the whole file, Nyanzi should not have been put to her defense

Well well well !!

Kamasanyu is an incompent, biased tribal magistrate.

The day she announced that the accuser could not appear in court because it was "unconstitutional " would have been the day this thing was killed and buried .

Every accused must face his or her accuser .If it doesn`t fit , you must aquit !

As if that was enough ,Museveni has said that "he is not annoyed " by what they write about him .

"it is the police that is making big cases out of small things" this was what Museveni said only hours ago.

So , is the prosecutor or Kamasanyu getting annoyed on behalf of someone who t says he is not annoyed ?
NONSENSE !!!!

High court MUST release Dr Nyanzi with apology & NOW, to prove it's not Museveni's tool to try/lock up Ugandans & ensure there is no opposition to the demon!

So far, this so called justice is confirming to the entire world that it's Museveni it works for & ensures his lifetime tribalistic diabolical rule that leaves no place for opposition/challenged!

How can any one who has attended law school even think of imprisoning Dr Nyanzi, bringing her to justice & what/whose justice?

Ugandan uneducated, those without income are more human that the so called educated helping Museveni silence Ugandans & make them slaves for ever!

There is no case against the lady in the first place. The state should come out with a face-saving strategy and dismiss the whole case.

Calling someone that he/she has a big behind (gluteus maximus) is just stating the fact. The man himself once stated that one should not stick his/her finger in that/his leopard's a-hole. Something he acknowledged himself.

In some parts of the country, women/young girls are fattened like cows (on dairy products) before marriage in order to grow big booties.

What a flatulence (they become) and degrading backwards practice and culture. Of course the so-called Ugandan Louis Pasteur (one Kaguta) thought them how to boil milk before drinking. What an insult to his own people who worship him.

Dr Nyanzi MUST be RELEASED & charges against her DROPED, if there's justice & those handling it are qualified!

This so called high court is ensuring Museveni's 33+ years rule, unconcerned that Ugandans, including those in so justice, are powerless tribalistically divided & ruled slaves of the conqueror!

Museveni made the people to whom the country formd by their tribal lands belong, enemies of one another while he uses those in posts to ensure he rules for life!

How will Ugandans look at one another, have a start, when Museveni will be no more?

Ugandans have surrendered their country to Museveni/family & are slaves, migrants, refugees in their own land willingly, WHY?!

In other words Wooden, unlike Mr. Trump, Mr. M7 man has deflected the local and international accusation; that the man is a weak, thin-skin, spineless dictator who uses the state apparatus like the police and the courts to fight petty personal war with the citizens.
